It protects your family, saves them from fights, and ensures your wishes <\/span><span data-preserver-spaces=\"true\">are followed<\/span><span data-preserver-spaces=\"true\">. <a href=\"https:\/\/1finance.co.in\/request-a-callback\">Writing a will<\/a> is one of the most important things you can do for those you love.<\/span><\/p>\n<p><strong>A will does three key things:<\/strong><\/p>\n<ol>\n<li><span data-preserver-spaces=\"true\">It clearly states who gets what.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">It protects your family from legal battles.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">It ensures your children are cared for.<\/span><\/li>\n<\/ol>\n<p><span data-preserver-spaces=\"true\">With a will, you decide who handles your assets and how. You can name guardians for your kids and set aside money for their future. <\/span><\/p>\n<h2>What is a Will?<\/h2>\n<p><span data-preserver-spaces=\"true\">The definition of a &#8220;Will&#8221; can be found in the <a href=\"https:\/\/www.indiacode.nic.in\/bitstream\/123456789\/2385\/1\/a1925-39.pdf\">Indian Succession Act<\/a> of 1925, which applies to wills made by Hindus, Sikhs, Christians, Jains, and Buddhists. <\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Section 2(h) of the Indian Succession Act<\/span><span data-preserver-spaces=\"true\"> defines a will as follows: &#8220;<span style=\"text-decoration: underline;\">Will means <\/span><\/span><span style=\"text-decoration: underline;\">the legal declaration of the intention of the Testator with respect to his property which he desires to be carried into effect after his death.<\/span><span data-preserver-spaces=\"true\">&#8220;<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">In simpler terms, a will is a legal document <\/span><span data-preserver-spaces=\"true\">where<\/span><span data-preserver-spaces=\"true\"> a person declares their intention to transfer their property to another individual, who may or may not be a legal heir. A will only <\/span><span data-preserver-spaces=\"true\">take<\/span><span data-preserver-spaces=\"true\"> effect after the person&#8217;s death.<\/span><span data-preserver-spaces=\"true\"> While the person is alive and capable of managing their property, they can change or revoke the Will at any time.<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">Importance of Writing a Will in India <\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">Writing a valid will is essential. One of the key benefits of having a will is the ability to plan for the care and financial security of minor children or dependents. Without a will, the courts decide how funds are allocated and who will become the guardians in the event of the parent&#8217;s death. However, a will enables parents, or a single parent, to designate guardians and allocate funds for their children&#8217;s future. Will also serves a crucial purpose by clearly distinguishing between a nominee and a beneficiary. The nominee temporarily holds the property until it is distributed according to the Will, while the beneficiary is the one who ultimately receives the property. A will allows the testator to efficiently appoint a nominee for asset distribution.<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">Essential Elements of a Valid Will <\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">While a will does not need to <\/span><span data-preserver-spaces=\"true\">be made<\/span><span data-preserver-spaces=\"true\"> on stamp paper, <\/span><span data-preserver-spaces=\"true\">certain key elements must be included<\/span><span data-preserver-spaces=\"true\"> to ensure that it holds up legally in case of any disputes. These essential elements are:<\/span><\/p>\n<ol>\n<li><strong><span data-preserver-spaces=\"true\">Age &amp; Capacity<\/span><\/strong><span data-preserver-spaces=\"true\">:<\/span>\n<ul>\n<li><span data-preserver-spaces=\"true\">Section 59 of the Indian Succession Act 1925<\/span><span data-preserver-spaces=\"true\"> states that a will is invalid if <\/span><span data-preserver-spaces=\"true\">it <\/span><span data-preserver-spaces=\"true\">is<\/span><span data-preserver-spaces=\"true\"> made<\/span><span data-preserver-spaces=\"true\"> by a person who is not of sound mind or is a minor.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">The person making the Will should be at least the legal age of majority, i.e., 18 years, and <\/span><span data-preserver-spaces=\"true\">should<\/span><span data-preserver-spaces=\"true\"> be of sound mind.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">A sound mind implies that the person <\/span><span data-preserver-spaces=\"true\">making a will must have sufficient mental capacity to<\/span><span data-preserver-spaces=\"true\"> understand their actions.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><strong><span data-preserver-spaces=\"true\">Clear Intent<\/span><\/strong><span data-preserver-spaces=\"true\">:<\/span>\n<ul>\n<li><span data-preserver-spaces=\"true\">Section 61 of the Indian Succession Act declares that <\/span><span data-preserver-spaces=\"true\">if<\/span><span data-preserver-spaces=\"true\"> a will or any part of it is obtained by fraud, coercion, or undue influence<\/span><span data-preserver-spaces=\"true\">, it is void<\/span><span data-preserver-spaces=\"true\">.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">The document must clearly state the intention of the person making the Will.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><strong><span data-preserver-spaces=\"true\">Writing<\/span><\/strong><span data-preserver-spaces=\"true\">:<\/span>\n<ul>\n<li><span data-preserver-spaces=\"true\">The Will must be written, not oral.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Many jurisdictions require it to be handwritten or typed, though some accept wills typed and printed by others if signed by the testator.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><strong><span data-preserver-spaces=\"true\">Signing the Will<\/span><\/strong><span data-preserver-spaces=\"true\">:<\/span>\n<ul>\n<li><span data-preserver-spaces=\"true\">The Will must <\/span><span data-preserver-spaces=\"true\">be signed<\/span><span data-preserver-spaces=\"true\"> in accordance with Section 63 of the Indian Succession Act.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">The person making the Will (the testator) must sign it or place a mark on it.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Alternatively, someone else can sign the Will on behalf of the testator, but <\/span><span data-preserver-spaces=\"true\">this must be done<\/span><span data-preserver-spaces=\"true\"> in the testator&#8217;s presence and with their permission.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">The signature or mark must be placed<\/span><span data-preserver-spaces=\"true\"> in a way that clearly shows the testator intended to make the document a valid will.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><strong><span data-preserver-spaces=\"true\">Witnesses<\/span><\/strong><span data-preserver-spaces=\"true\">:<\/span>\n<ul>\n<li><span data-preserver-spaces=\"true\">According to Section 63, the Will must <\/span><span data-preserver-spaces=\"true\">be witnessed<\/span><span data-preserver-spaces=\"true\"> by at least two people.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Each witness must either see the testator sign or mark the Will, see someone else sign it on <\/span><span data-preserver-spaces=\"true\">the testator&#8217;s<\/span><span data-preserver-spaces=\"true\"> behalf, or hear the testator acknowledge that the signature or mark is theirs.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Every witness shall sign the Will in the presence of the testator. <\/span><span data-preserver-spaces=\"true\">However, <\/span><span data-preserver-spaces=\"true\">it&#8217;s <\/span><span data-preserver-spaces=\"true\">not necessary<\/span><span data-preserver-spaces=\"true\"> for all the witnesses to be<\/span><span data-preserver-spaces=\"true\"> present <\/span><span data-preserver-spaces=\"true\">at the same time<\/span><span data-preserver-spaces=\"true\">.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">There&#8217;s no specific format required for the witnesses&#8217; signatures.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<h2><span data-preserver-spaces=\"true\">Important things to remember while writing a will<\/span><\/h2>\n<ol>\n<li><strong><span data-preserver-spaces=\"true\">Beneficiaries<\/span><\/strong><span data-preserver-spaces=\"true\">:<\/span>\n<ul>\n<li><span data-preserver-spaces=\"true\">Clearly<\/span><span data-preserver-spaces=\"true\"> identify the individuals who will receive your assets (beneficiaries).<\/span><\/li>\n<\/ul>\n<\/li>\n<li><strong><span data-preserver-spaces=\"true\">Keep it in Writing<\/span><\/strong><span data-preserver-spaces=\"true\">:<\/span>\n<ul>\n<li><span data-preserver-spaces=\"true\">Although <\/span><span data-preserver-spaces=\"true\">there is no explicit requirement in the law that a will must<\/span><span data-preserver-spaces=\"true\"> be in written form, Section 63 of the Indian Succession Act of 1925 outlines the formal requirements for <\/span><span data-preserver-spaces=\"true\">the execution of a will<\/span><span data-preserver-spaces=\"true\">.<\/span> <span data-preserver-spaces=\"true\">It specifies that the Will must be signed by the testator and witnesses.<\/span> <span data-preserver-spaces=\"true\">This<\/span><span data-preserver-spaces=\"true\"> implicitly means that the Will must be<\/span><span data-preserver-spaces=\"true\"> a <\/span><span data-preserver-spaces=\"true\">written <\/span><span data-preserver-spaces=\"true\">document<\/span><span data-preserver-spaces=\"true\"> since signing and witnessing require a physical or written document.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><strong><span data-preserver-spaces=\"true\">Executors<\/span><\/strong><span data-preserver-spaces=\"true\">:<\/span>\n<ul>\n<li><span data-preserver-spaces=\"true\">Appoint one or more individuals to manage your estate and carry out the Will&#8217;s instructions.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<p>A well-written will is your lasting gift of care and protection.<br \/>\nIt is an essential step in securing your legacy and ensuring that your wishes are honoured after you&#8217;re gone.
