Even if the property is registered in your name, it may not legally belong to you. Surprising or baffling as it may sound, the Supreme Court, the apex Court of India has made this clear in a recent ruling.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Registration, the Supreme Court said, is only one part of the process. On its own, it doesn\u2019t prove ownership. To be recognised as the legal owner, you must also have the full set of title <a href=\"https:\/\/1finance.co.in\/blog\/organise-your-financial-documents-with-doculocker\/\" target=\"_blank\" rel=\"noopener\">documents<\/a>, proof of payment, and legal possession of the property. Without these, the registration is incomplete in the eyes of law.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This clarification has shaken up the <a href=\"https:\/\/1finance.co.in\/surveys\/india-housing-market\">real estate sector<\/a>, which for years has operated under the assumption that registration equaled ownership.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In this article we will talk about what Supreme Court means and if not registration what will make the property actually yours?<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">What did the Supreme Court say regarding ownership?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The Supreme Court said that just registering a <a href=\"https:\/\/1finance.co.in\/blog\/important-terminologies-related-to-income-from-house-property-heres-what-you-need-to-know\/\" target=\"_blank\" rel=\"noopener\">property<\/a> isn\u2019t enough to prove you legally own it. If the person selling the property didn\u2019t have the right to sell it in the first place, then even a properly registered sale deed doesn\u2019t count for much.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Also, if the earlier agreement to sell the property wasn\u2019t registered, then later steps, like registering the final deed or taking physical possession, still don\u2019t prove legal ownership.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Let\u2019s understand this with an example.\u00a0 If you buy a flat from someone named Kanan. You sign the sale deed, pay the consideration agreed, and get it registered at the sub-registrar\u2019s office.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Now, on paper, it looks like you&#8217;re the new owner. Well not so fast. Kanan himself didn\u2019t legally own the flat; he didn&#8217;t have the legal right to sell it.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Now even though your sale deed is registered, the law doesn\u2019t see you as the true owner\u2014because Kanan didn\u2019t have any right to sell it in the first place. It\u2019s like getting a receipt for a stolen item. The receipt proves you bought it, but it doesn\u2019t prove it was Kanan\u2019s asset to sell.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">There\u2019s more to the story. Let\u2019s say before you registered the sale, you and Kanan signed a basic agreement to sell the property, but you never registered that initial agreement. Even if you later went ahead and registered the final sale deed and moved into the flat, the law still won\u2019t fully recognise you as the legal owner.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Why? Because the chain of ownership is broken.
