Finding your Way Out of Financial Pitfalls in Divorce: Insights from Mr. Shonee Kapoor

Mr. Shonee Kapoor, a legal consultant and advocate for men's rights, provides a crucial perspective on handling financial complications during divorce, with a focus on divorce financial planning, especially for men who find themselves falsely implicated in dowry and domestic abuse cases.

You've been actively advocating for men's rights, especially those wrongly accused in cases like divorce and dowry. What inspired your involvement in this cause?

I became involved in advocating for men's rights after being falsely accused in a dowry harassment case by my ex-wife. This included a brief jail time due to the non-bailable nature of the offence, which opened my eyes to the challenges many men face under similar accusations.

How did the legal cases impact your finances?

The legal battles significantly impacted my professional life and finances. I experienced a decline in job performance, which affected my career growth through missed promotions and increments. The frequent travel required for court appearances in another city also posed a substantial financial burden. For many, the financial strain is compounded by the obligations of maintenance and alimony, which can consume a large portion of their income.

What steps should one take if they decide to separate due to cheating, abuse, or lack of commitment from their partner?

If one suspects their partner of infidelity or abuse, or if the relationship deteriorates, it’s crucial to have a plan:

  • Premarriage: Consider financial protection strategies like transferring assets to protect them in the event of a divorce.
  • During marriage: Maintain financial independence where possible, such as renting from a family member to establish tenancy or avoiding joint loans, which could complicate asset division.
  • Legal preparation: Recognise that while divorce is stigmatised, preparing financially is critical. This includes setting up a clear will and regularly updating it to reflect current assets and family dynamics.

How should expenses be managed to ensure financial fairness?

The division of expenses should align with each partner's earning capacity. If both partners work, splitting expenses based on their income ratios is sensible.

It's recommended to maintain both joint accounts for common expenses and individual accounts for personal finances.

Avoid purchasing joint properties or assets like gold which could complicate separation processes.

What is the typical approach to calculating alimony and maintenance in India?

Unlike many Western countries where assets are typically split equally, India lacks fixed rules for alimony. Proposals exist for laws granting up to 50% of the husband's property to the wife and children at divorce, though none have passed yet.

What legal and financial challenges are typically faced during divorce settlements?

Legal fees for divorce vary significantly depending on the lawyer and case complexity. A typical settlement could cost a man significantly, depending on his annual earnings, while a woman might face lower attorney fees. These figures highlight the financial implications of divorce, emphasizing the importance of financial planning for a divorce.

With increasing financial independence, how can India prepare for a rise in divorce cases?

Effective measures include expediting divorce case resolutions, upholding pre-nuptial agreements and imposing strict penalties for false allegations. These strategies aim to minimise the duration and emotional strain of divorce proceedings, adapting to the changing social landscape as financial independence grows.

Through his insights, Mr. Shonee Kapoor provides a comprehensive guide for men to manage financial risks in divorce, emphasising legal preparedness, fair maintenance practices and the importance of financial planning before and during marriage.
